OVERVIEW: A deputy postmaster was not entitled to recover his salary for a period during which he was suspended because under the tenure-of-office act, passed March 2, 1867 (14 Stat. 403), amended April 5, 1869, (16 Stat. 6), his replacement who was performing his duties during the suspension was entitled to draw his salary.
