OVERVIEW: A railroad's cross-bill against the State of Tennessee in a bankruptcy action, based on a contract that the railroad had with the State, was properly dismissed because the State could not be sued in its own courts. An earlier law allowing such suits did not contain any remedy. Thus its repeal did not violate the Contracts Clause.
