OVERVIEW: Lessees were not liable to a lessor for rent, as stipulated in a lease of 1859, for the period in which the leased storehouse was under control of the United States military, beginning in 1862. The lessees were permanently deprived, by competent public authority, of the possession of the leased property and were discharged from paying rent.
