OVERVIEW: Georgia Supreme Court did not deprive plaintiff in error of due process by dismissing writ of error to review his murder conviction because he escaped and was fugitive from justice when his case was called and he failed to submit to court's jurisdiction as ordered within 60 days. He was recaptured after 60 days elapsed and was resentenced to death.
