OVERVIEW: In ejectment action by mortgagor's grantee against mortgagee in possession following a foreclosure and sale, mortgagee was entitled to judgment because an Illinois act of 1872 operated in violated of Constitution of the United States, as it materially impaired obligation of the mortgage, and deprived mortgagee of her property without due process.
