OVERVIEW: A non-producing wholesale and retail milk vendor was properly fined under § 37 of chapter 338 of the laws of New York for retailing milk at less than 12 percent milk solids. There was no constitutional violation in allowing exemptions only to producing vendors because the object of the law was to prevent non-producers from diluting milk.
