OVERVIEW: A countess's tort action brought under Rev. Stat. § 563 to recover compensation for cattle slaughtered in Cuba was properly dismissed because she had no property that survived the extinction of the sovereignty of Spain. Emoluments to which she claimed a right were the incident of an office, which right did not exist as against the United States.
