OVERVIEW: The use of Indian treaty and trust funds, appropriated pursuant to the Sioux Treaty of April 29, 1868, 15 Stat. 635, 637, or Indian Appropriation Acts of 1895, 1896, 1897, 1898 and 1899, was permissible; Government had duty to educate Indians, they had right to choose religious education, and money belonged to them and was not like public money.
