OVERVIEW: Claimant successfully repelled a charge of illicit importation based on large admixture of spirits with imported spirits where evidence showed that brandy imported in casks that were seized was in part the same brandy described in certificates required under § 43 of the Revenue Law and in part domestic spirits that were not subject to import law.
