OVERVIEW: Because among creditors equally meritorious, debtor could have conscientiously preferred one to another, even if preferred creditor was his wife, articles of marriage were good between the parties, and as delivery of notes that served as basis for debt was made in part performance of such articles, debtor's moral and legal duty were dismissed.
