OVERVIEW: A judgment dismissing an indictment charging defendant with antitrust violations and conspiracy could not stand because the Act of February 25, 1903, 32 Stat. 854, 904, 15 U.S.C.S. § 32 applied only to persons testifying in judicial proceedings and defendant's testimony before a congressional subcommittee did not immunize him from prosecution.
