OVERVIEW: When a candidate for a state university teaching position refused to take a required oath, his suit for declaratory relief was improperly dismissed. The oath was to be read in conjunction with the Ober Act (Art. 85A, Md. Ann. Code, 1957), which in defining "subversive" was overbroad in that it made possible oppressive or capricious applications.
