OVERVIEW: 28 U.S.C.S. § 1253 provided for a direct appeal from a three-judge district court to the U.S. Supreme Court only from an order granting or denying an injunction. Thus, when a three-judge district court found an statute unconstitutional but did not actually grant or deny an injunction, the Court had no jurisdiction to hear an appeal from the order.
