1. Gunn v. University Committee to End War, No. 7, SUPREME COURT OF THE UNITED STATES, January 13-14, 1969, Argued , June 29, 1970, Decided
OVERVIEW: 28 U.S.C.S. § 1253 provided for a direct appeal from a three-judge district court to the U.S. Supreme Court only from an order granting or denying an injunction. Thus, when a three-judge district court found an statute unconstitutional but did not actually grant or deny an injunction, the Court had no jurisdiction to hear an appeal from the order.
