OVERVIEW: Appellate court properly determined sua sponte that claims against government in U.S. Court of Federal Claims were untimely under 28 U.S.C.S. § 2501, even though government waived timeliness, since longstanding and consistent precedent established that limitations period was jurisdictional and overturning that precedent was not warranted.
