Citation: 2009 U.S. App. LEXIS 21465

1. Bd. of Trs. of the Leland Stanford Junior Univ. v. Roche Molecular Sys., 2008-1509, 2008-1510, UNITED STATES COURT OF APPEALS FOR THE FEDERAL CIRCUIT, September 30, 2009, Decided

OVERVIEW: Court of appeals vacated district court's judgment that patents which described methods for quantifying HIV in blood samples were invalid because university that claimed patent infringement lacked standing to sue. University's inability to establish that it possessed a researcher's interest in the patents defeated its right to assert infringement.
