Overview: Grant of 28 U.S.C.S. § 2241 habeas petition was affirmed because further prosecution of pretrial detainee would have violated the Double Jeopardy Clause. Absence of a witness did not give rise to manifest necessity for mistrial, which was granted by state court in detainee's manslaughter case after a jury was empaneled and two witnesses were heard.
