Overview: A conviction for conspiring to retaliate against a witness was upheld. Even if certain testimony was improperly admitted as an "excited utterance," its admission constituted harmless error because the evidence of a conspiracy was overwhelming, particularly as there was a video surveillance of the assault and testimony of defendant's conversations.
