Overview: Because indictment alleged conjunctively two ways that defendant was alleged to have violated 21 U.S.C.S. § 841(a)(1) and (b)(1)(B)(iii) -- by intending to distribute cocaine and cocaine base -- trial court properly instructed jury that it could find him guilty if it found that he possessed and intended to distribute either controlled substance.
