Overview: Defendant, who pleaded guilty to misprision of a felony based on a money laundering scheme, was erroneously sentenced because the laundered funds for which defendant was accountable under U.S. Sentencing Guidelines Manual § 2S1.1(a)(2) (2004) was the amount originally derived from the criminal activity, which excluded any appreciation in its value.

Overview: At trial for conspiracy to possess with intent to distribute cocaine, district court did not err in admitting under Fed. R. Evid. 404(b) defendant's statement that he was recently arrested for possession of marijuana, as his intent to join conspiracy was at issue and marijuana arrest was indicative of intent where cocaine was packaged in marijuana.
