Overview: Because the district court had not originally used a wrong USSG, imposed a sentence different than in a plea agreement, or imposed an illegal sentence, its corrected sentence was vacated; resolving the mandatory minimum and safety valve issue that prompted the sentence modification was not clear error such that Fed. R. Crim. P. 35(a) could be used.
