Overview: Evidence was sufficient to sustain defendant's conviction for alien smuggling under 8 U.S.C.S. § 1324 because there was evidence that defendant operated a boat that was filled with aliens at a Dominican harbor under cover of darkness and brought to the Virgin Islands to a location that was neither intended nor designed as a port of entry.

Overview: A petition for review was denied. Pursuant to 8 U.S.C.S. § 1158(a)(2)(D), (3), appeals court could not review denial of untimely-filed asylum application. Aliens did not present evidence to support their CAT relief claims. They did not show that they had reasonable fear of future persecution in Indonesia, due to their Chinese-Christian identities.
