Overview: Where defendant was convicted of, inter alia, filing a false claim with the IRS under 18 U.S.C.S. § 287, the district court erred in excluding the Government's evidence of additional losses under U.S. Sentencing Guidelines Manual § 1B1.3, because Booker did not change the manner in which the correct guidelines range was calculated.

Overview: Sentencing appeal was denied. District court did not err in granting three level substantial assistance departure under U.S. Sentencing Guidelines Manual § 5K1.1 and in imposing two level "use of minor" enhancement under U.S. Sentencing Guidelines Manual § 3B1.4. Defendant had done more than merely jointly participate with minor in drug conspiracy.
