Overview: Defendant's conviction and sentence was affirmed. As defendant's state conviction met definition of controlled substance offense under USSG § 4B1.2(b), it could be used for career offender status. State conviction also fell within felony drug offense definition of 21 U.S.C.S. § 802(44), so enhanced penalties under 21 U.S.C.S. § 841(b) was affirmed.
