Overview: Defendant's conviction and sentence was affirmed. As defendant's state conviction met definition of controlled substance offense under USSG § 4B1.2(b), it could be used for career offender status. State conviction also fell within felony drug offense definition of 21 U.S.C.S. § 802(44), so enhanced penalties under 21 U.S.C.S. § 841(b) was affirmed.

Overview: District court did not err in applying two level obstruction of justice enhancement to defendant's USSG range. Inconsistencies in alibi witness's testimony and fact that jury disbelieved her account of what happened sufficed to support finding that witness committed perjury; conclusion that defendant procured witness's testimony was also supported.
