Overview: A BIA order denying an alien 8 U.S.C.S. § 1182(c) (repealed) relief because she had not sought relief before the statute was repealed, was vacated, and on remand, she could show she waited to apply for relief, to establish a stronger rehabilitation record, in actual reliance on a reasonable belief it would be available at deportation proceedings.
