Overview: Although courts had questioned continuing validity of allowing testimonial hearsay at sentencing post-Crawford and post-Booker, Sixth Circuit held that, without a clear directive from Supreme Court, it would continue to observe its precedent that testimonial hearsay did not affect a defendant's Sixth Amendment right to confrontation at sentencing.
