Overview: There was ample evidence from which a jury could conclude that defendant knowingly entered into an agreement with the co-defendant to violate the drug laws, and that defendant actively participated in the conspiracy because co-defendant testified that after he completed the drug transaction, he surrendered the money to defendant.

Overview: Seventy-eight month sentence was reasonable, as any disparity between defendant's sentence and sentences in "fast-track" districts did not violate 18 U.S.C.S. § 3553(a)'s instruction to avoid unnecessary sentencing disparities. Fast-track sentence reductions were statutorily authorized due to unique problems regarding immigration in some districts.
