Overview: Where a state inmate was not aware of a state trial court's failure to rule on a motion for new trial, the failure to rule on the motion did not prevent inmate from filing his notice of appeal. Thus, rather than having been denied his right to appeal and, thus, his right to due process, the inmate abandoned his right to appeal.
