Overview: As an appeal waiver in defendant's plea agreement was binding, his Booker challenge to his sentence was frivolous. The appeal waiver was enforceable against the Booker challenge even though it was executed before Booker was decided, because the waiver did not incorporate an exception allowing for arguments based on future changes in the law.
