Overview: Summary judgment was properly entered against terminated employee as to his 42 U.S.C.S. § 12112(b)(5)(A) failure to accommodate claim because there was no triable issue of fact as to whether he was qualified individual with disability as defined in 42 U.S.C.S. § 12111(8). Employee was unable to work for extended periods because of his poor health.

Overview: In a robbery trial, the district court did not abuse its discretion in barring a statement from counsel for a co-defendant that indicated defendant was at the robbery but did not know what was about to happen. Overview: Defendant's life sentence, imposed for racketeering and drug conspiracy crimes, was affirmed following a limited Booker remand.
