Although defendant suggested that application of career offender guideline created an unwarranted disparity and thus that the district court should have reduced his sentence, his increased offense level was authorized under the USSG; therefore it was frivolous to argue that defendant's sentence was unreasonable.

Overview: Defendant's conviction for possession of a gun by felon, a violation of 18 U.S.C.S. § 922(g)(1), was affirmed. When defendant claimed that gun belonged to his girlfriend, evidence of a prior incident in which he made the same claim was admissible under F. R. Evid. 404(b) to show the unlikelihood of a mistake happening twice in a short span of time.
