Overview: Defendant's retrial on wire fraud charges, 18 U.S.C.S. § 1343, did not result in double-jeopardy error under the Fifth Amendment because there was no indication that the government intended to elicit the improper information from its witness that provoked the mistrial. In addition, the jury instructions did not improperly shift the burden of proof.

Overview: Alien did not dispute that his child abuse conviction was a crime involving moral turpitude. He was thus not eligible for adjustment of status until he received a waiver under 8 U.S.C. § 1182(h). Grant of a waiver was within the Attorney General's discretion, and thus alien's mandamus request failed. Alien did not establish elements of estoppel.
