Overview: The government conceded that the base offense level should have bee n 18under U.S. Sentencing Guidelines Manual § 2A5.2(a)(2) instead of 9 under § 2A5.2(a)(4), but argued that the error was harmless. The court held that it was not harmless because there was no discussion of § 2A5.2(a)(2) during the district court proceedings.
