Overview: The government conceded that the base offense level should have bee n 18under U.S. Sentencing Guidelines Manual § 2A5.2(a)(2) instead of 9 under § 2A5.2(a)(4), but argued that the error was harmless. The court held that it was not harmless because there was no discussion of § 2A5.2(a)(2) during the district court proceedings.

Overview: Substantial evidence did not support denial of asylum based on finding that alien and wife voluntarily consented to wife's sterilization because wife went to hospital for tubal ligation procedure after years of fines and penalties for violating China's family planning policy and government notified her it was enforcing sterilization policy on her.
