Overview: When defendant knowingly and voluntarily waived right to appeal his sentence, and he was sentenced within terms of plea agreement, the waiver was valid and enforceable. Thus, the court dismissed his appeal with respect to the 240-month sentence imposed upon his conviction of distribution of cocaine base and being a felon in possession of a firearm.

Overview: Under Fed. R. Crim. P. 32(i)(3)(A), district court could rely on statement in PSI that defendant had prior drug conviction because he did not object to statement at sentencing. Thus, district court did not err by imposing 12-level enhancement under USSG § 2L1.2(b)(1)(B) when sentencing him for unlawfully reentering country after prior deportation.
