Overview: Defendant's conviction for carrying an explosive during the commission of a felony, a violation of 18 U.S.C.S. § 844(h)(2), was reversed because, like 18 U.S.C.S. § 924(c), 18 U.S.C.S. § 844(h)(2) included a relational element, and no evidence was presented that defendant's explosives were used to facilitate his false customs declaration.
