Overview: Appellate court did not need to consider whether 8 C.F.R. § 316.10(b)(3)(iii) ran afoul of the Uniformity Clause, U.S. Const. art. I, § 8, cl. 4, because the regulation was unquestionably constitutional as applied to defendant; the crimes of arson, willful injury of a child, and fraud were considered unlawful in all jurisdictions.
