Overview: An independent state electric system operator violated the Federal Power Act, 16 U.S.C.S. § 824d(c), (d), and 18 C.F.R. § 35.1(a) by failing to file its new method of calculating electric capacity options with FERC prior to implementing the change in 2002, causing a shortfall in the state's electricity reserve margin and overcharging a retailer.
