Overview: The DOT's decision was vacated as to an airport operator owing refunds to foreign airlines because 49 U.S.C.S. § 47129's reference to air carriers "as defined in § 40102 of this title" incorporated 42 U.S.C.S. § 40102(a)(2)'s limitation to U.S. citizens, not foreign carriers under § 40102(a)(21); the foreign carriers should have been dismissed.
