Overview: Substantial evidence, as required by 5 U.S.C.S. § 7703(c) for affirmance, supported the MSPB's conclusion on charges the employee (1) misrepresented hours spent on assigned work, i.e., ensuring that certain software programs could be tested on an automated testing system the agency had adopted, and (2) failed to carry out assigned work.
