Overview: By denying summary judgment only on issues raised by motions for summary judgment, district court did not clearly decide all of the relief sought by the counterclaimants. Since not all claims for relief were disposed of, and no judgment was entered per Fed. R. Civ. P. 54(b), there was no final judgment and appeal had to be dismissed as premature.
