Overview: Recovery of damages under 25 U.S.C.S. § 1779f of settlement legislation did not apply to the Cherokee Nation of Oklahoma (CNO), but rather provided for the settlement of claims of the United Keetoowah Band (UKB). The U.S. Court of Federal Claims erred in dismissing UKB's claim for failure to join the CNO Tribe as a necessary party.
