Overview: As a widow could not recover medical expenses from a manufacturer in her wrongful death action, the right of equitable subrogation afforded to the insurer of her husband's employer by Ala. Code § 25-5-11(a) did not allow the insurer to recover medical benefits it had paid on behalf of husband from the proceeds of the widow's wrongful-death action.
