Overview: A quiet title action under Ala. Code § 6-6-540 was improperly resolved in favor of a cemetery association. The association did not show that a church had scrambling rather than peaceable possession of a disputed cemetery, the church properly showed that it had peaceable possession, and the association did not show that it had acquired legal title.
