Overview: A quiet title action under Ala. Code § 6-6-540 was improperly resolved in favor of a cemetery association. The association did not show that a church had scrambling rather than peaceable possession of a disputed cemetery, the church properly showed that it had peaceable possession, and the association did not show that it had acquired legal title.

Overview: Trial court properly refused to set aside second default judgment against defendant under Ala. R. Civ. P. 60(b) because he lacked a meritorious defense, he waited three and a half months after second default judgment was entered before requesting that it be set aside, and he had repeatedly refused to respond to pleadings, motions, and court orders.
