Overview: Because an uninsured motorist's statute-of-limitations defense, a procedural defense, was not available to an insurer in defense of a claim for uninsured-motorist benefits, the Court of Civil Appeals erred in concluding otherwise, because only the uninsured motorist's substantive defenses were available to the insurer.

Overview: Trial court erred in rebating the interest on a father's child support arrearage amount, when, despite the fact that the father met the requirements of Ala. Code § 30-3-6.1(a)(1), he failed to meet the requirements of Ala. Code § 30-3-6.1(b) in that neither the mother nor the State agreed to the rebate of interest in writing.
