Overview: An ordinance levying taxes to fund county warrants for capital improvements of the public schools in the county was upheld as valid as within the county's authority under Ala. Code § 40-12-4 since schools were public buildings and the planned distribution method was within the legislative intent of Ala. Code § 11-28 for education taxes.
