Overview: As a second insurer breached its duty of care to protect a first insurer's subrogation interest, in the second insurer's subsequent settlement with the first insurer's insured, the first insurer could sue the second to recover the amount of its subrogation claim. Thus, summary judgment to the first insurer in the amount of said claim was upheld.

Overview: In a DUI case, as Ala. Code § 36-18-2 afforded defendant the right to inspect and copy the department of forensic sciences' repair records concerning breath-alcohol-analysis devices, as they were public records, the prosecutor was not obliged under Ala. R. Crim. P.16.1 to compile such records on defendant's behalf.
