Overview: Judgment was affirmed as Alabama Department of Corrections and employee remained at odds as to backpay award after DOC made de facto concession that employee was improperly dismissed. Under Ala. Code § 36-26-27(a), only Alabama State Personnel Board could reinstate classified employee, and it had discretion to impose conditions on reinstatement.
