Overview: When a victim's father was convicted of sexually assaulting her, and a jury was to consider an aggravated sentence, the State could receive the victim's counselor's records, as to emotional harm, under Ariz. Rev. Stat. ¿ 13-702(C)(9) (Supp. 2005), only if it showed that the records were essential to proving an aggravated sentence should be imposed.
