Overview: Although there was abundant evidence that a driver who knowingly drove under the influence of methamphetamine and ran a red light acted with a conscious disregard for the safety of others, a personal injury claimant was not entitled to punitive damages as a matter of right; it was the jury's prerogative to find that the driver acted without malice.
