Overview: In an action alleging bad faith in a delayed payment of underinsured motorist coverage, there was a triable issue of fact as to the sufficiency of the investigation raised by the insurer's purported failure to have the insured examined by a doctor of its choice or to consult with her treating physician. Thus, summary judgment was not appropriate.
