Overview: Where there was some evidence that a doctor did not take steps to obtain MRI results, the opinion of patient's expert that doctor acted below the standard of care in that respect was based on facts supported by the record. Accordingly, it was error to disregard that portion of the expert's declaration opposing doctor's motion for summary judgment.
